Privacy Policy.

When you use Seavee’s Website or Mobile Application (“Services”), you trust us with your information. This Mobile Services Privacy Policy (“Privacy Policy”), which supplements our Website Privacy Policy, is meant to help you understand what information we collect, why we collect it, and what we do with it when you use our mobile application (“Mobile Services”). This policy is important, and we hope you will take time to read it carefully. You can find controls to manage your information and protect your privacy and security in your account settings as well as the “edit” options throughout our services.

There are different ways you can use our Mobile Services—to plan projects, to keep track of certification and payment dates, to store and send documents, to compile a resume, and to communicate using our servers. When you share information with us, for example, by creating a Seavee account, we can better ensure the quality of our services—to help you connect with people and to make sharing with others quicker and easier. As you use our Mobile Services, we want you to be clear how we’re using the information we collect and you provide us and the ways in which you can protect your privacy.

Our Privacy Policy explains:

·      what information we collect;

·      why we collect it;

·      how we use that information (what we do with it); and

·      the choices we offer you for managing your privacy, including how to access and update the information you provide us.

We’ve tried to keep this policy as simple as possible, but if you’re not familiar with terms like cookies, IP addresses, pixel tags and browsers, we recommend that you read about these key terms first online, using your preferred search engine. Your privacy matters to Seavee. Whether you are a new or a long-time user, please take the time to get to know our practices. If you have any questions, please contact us at info@seavee.net.

Information we collect.

We collect information to provide a better service to you and to those with whom you communicate using our Mobile Services.

Personal Data.

“Personal Data” is information that identifies an individual or relates to an identifiable individual (such as name, email address, and other identifying addresses for electronic communications). We need to collect Personal Data in order to communicate with you when you sign up for our Mobile Services or contact us directly. For example, our Mobile Services require you to sign up for a Seavee account. When you do, we’ll ask for personal information, like your email address and, if you subscribe to our premium version, a credit card to store with your account. Additionally, to provide our Mobile Services, we may collect and store information (including personal information) locally on your device using mechanisms such as application data caches.

Information we collect when you are signed in to Seavee may be associated with your Seavee account. When information is associated with your Seavee account, we treat it as personal information. For more information about how you can access, manage, or delete information that is associated with your Seavee account, visit the “Our transparency and your choices” section of this policy or email us at info@seavee.net.

Collection and Retention of Personal Data.

We do not collect personally identifying information through our Services unless a user consents to providing this information to us by (1) accepting our request to access it or (2) providing this information to us directly.

The only personally identifying information we collect and/or store is the information you provide to us through our Mobile Services, for example, when you create a user name, provide us with user information, provide us with local access to documents, consent to our use of mobile tools such as GPS, and/or upload documents that contain personal information (such as a resume). When you submit this information to us, we treat this as a consent for us to use it only for the purposes described below.

We will not use information provided through your use of this site except to communicate promotions, updates, and other news (e.g. information about our downloadable app and service, release dates, updates, and related offers) via email of through our Mobile Services; respond to direct inquiries; to measure and analyze traffic on and use of our Mobile Services; and/or to provide you the Mobile Services you have signed up for or have otherwise requested or directed us to provide. We will retain your information for as long as you subscribe to our services. If you unsubscribe, we will delete your information within a reasonable period of time.

Other Information.

Our Mobile Services may also collect Other Information via your browser or mobile phone operating system (whose privacy setting you may update as described below). “Other Information” is any information that does not reveal a person’s specific identity or does not directly relate to an identifiable individual, such as:

If we are required to treat Other Information as Personal Data under applicable law, then we may use and disclose it for the purposes for which we use and disclose Personal Data as detailed in this Privacy Policy.

We collect this information:

Information We Collect Through Automatic Data Collection Technologies.

As you navigate through and interact with Seavee’s Mobile Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, usage, and other patterns, including:

The information we collect automatically helps us to improve our Services and deliver a better and more personalized service, including by enabling us to:

The technologies we use for this automatic data collection may include:

·      Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. This allows us to collect information such as browser type, time spent on our Online Services, pages and content visited, and other anonymous web traffic data. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Online Services. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Online Services.

·      Web Beacons. Our Online Services may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

·      Analytics. We may use Google Analytics and Google Tag Manager, which uses cookies and similar technologies to collect and analyze information about use of our Online Services and report on activities and trends. This service may also collect information regarding the use of other websites, apps, and online resources. You can learn about Google’s practices by going to www.google.com/policies/privacy/partners. We may also use Flash and other technologies to collect additional analytics. If you do not want these Flash technologies stored on your computer, you can visit the Flash Player Storage Settings Manager page.

·      Mobile Carrier. If you are accessing our Mobile Services through a mobile device, your mobile device will send us data about your location based on your phone settings. We will ask you to opt-in before we use GPS or other tools to identify your precise location.

Sensitive Information.

We do not collect sensitive Personal Data in connection with this Website. Please do not send us any Personal Data such as information related to racial or ethnic origin, political opinions, religious or philosophical beliefs, health, biometric or genetic characteristics, criminal background or trade union membership (“Special Data”).

How we use the information we collect.

We use the information we collect from our Mobile Services to provide, maintain, protect, and improve them, to develop new services, and to protect Seavee and our users.

For example, when you first install the Seavee mobile application, you are asked for your email address and, optionally, your related industry. This information allows Seavee to provide and improve its services by understanding which industries are most frequently using our service.

Seavee only collects the personal information that you upload to your account and its servers. This information will be confidential and accessible only to you, those with whom you decide to share this content through our Mobile Services, Seavee, its employees, and its affiliates. Seavee will only have access to this information to the extent necessary to provide its Mobile Services. Seavee restricts your sharing of personal content to those individuals with whom you decide to share content. This sharing is a two-step process of (1) indicating your desire to “share” uploaded content through options on our user interface and (2) entering in the email address of the person with whom you would like to share this specific content. Once you decide to share this information, Seavee will send a copy of this information to the recipient, who will not have any additional access to your information or to Seavee’s servers.

Any data you upload to Seavee is accessible to you, and you may decide to edit this content at any time. If you decide to delete information you have uploaded, this information will be deleted from your mobile device’s local memory and Seavee’s servers. If you decide to delete your account, your information will be deleted from Seavee’s servers.

In order to offer its upload and import services, Seavee will require permission to access any associated mobile device and related third-party accounts. Seavee will not do so without your explicit permission. Additionally, in order to keep your information and documents up-to-date across your devices and Seavee’s servers, it is necessary to perform automatic syncs. This feature, however, can be turned off in the application’s “Settings.”

In order to offer your information the greatest protection, Seavee uses Google Cloud servers located in the United States. These servers meet a broad set of international and industry-specific compliance standards and are rigorously tested by third-party audits to verify adherence to strict security controls. You can visit Google Cloud’s website here for more information regarding their compliance and security measures.

Our transparency and your choices.

People have different privacy concerns. Our goal is to be clear about what information we collect, so that you can make meaningful choices about how this information is used. For example, you can:

·      Review and control certain types of information tied to your Seavee account; and

·      control whom you share information with through your Seavee account.

You may also set your browser to block all cookies, including cookies associated with our services, indicate when a cookie is being set by us, or restrict what information your mobile carrier shares with us by revising your mobile settings or opting out of certain tools we may use. However, it is important to remember that our services may not function properly if you disable such settings or opt out of certain tools.

Information you share.

Seavee’s Mobile Services allow you to share information with others. Please think carefully before sharing content. Remember that when you share this information, Seavee bears no responsibility for how third-parties may use this information. Although Seavee provides you with different options on sharing and deleting your content, Seavee cannot recall any copies of information that you have sent to third-parties through our services.

Your right to accessing and updating your personal information.

Whenever you use our services, we aim to provide you with access to your personal information. If that information is wrong, we strive to give you ways to update it quickly or to delete it—unless we have to keep that information for legitimate business or legal purposes. We provide you with editing tools within our mobile application so that you may edit or delete any information you have provided to us. If, for whatever reason, you are unable to edit your information, please email us at info@seavee.net.

We aim to maintain our services in a manner that protects information from accidental or malicious destruction. Because of this, after you delete information from our services, we may not immediately delete residual copies from our active servers and may not remove information from our backup systems.

Information we share.

We do not share personal information with companies, organizations, and individuals outside of Seavee unless one of the following three circumstances applies:

(1)          With your consent.

We will share personal information with companies, organizations, or individuals outside of Seavee only when you request that we do so.

(2)          For external processing.

We provide personal information to our affiliates or other trusted businesses or persons to process it for us, based on our instructions and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures.

When transferring personal information to such third parties, Seavee will enter into a contract with the third party providing that the data may only be processed for the limited and specified purposes consistent with what is described in this policy. Seavee will require any such third party to provide the same level of protection required by the Privacy Shield Principles to which Seavee is committed. If Seavee or any third party makes a determination that a contracted third party cannot fulfill these obligations, the third party will cease processing or take the reasonable and appropriate steps to remedy the situation.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to us. Any transmission of personal information is at your own risk, and we are not responsible for circumvention of any privacy settings or security measures related to this Website and its services. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us by emailing info@seavee.net.

We recognize that there are additional risks that countries, such as those in the EU, associate with transferring Personal Data to the United States. As a U.S.-based company, we work hard to mitigate these risk through our security measures but also by only using trusted third-party services to help store, protect, and transfer your information as well as communicate with you. To ensure this security, we use third-party services who are certified under the U.E.-US and EU-swiss Privacy Shields, operate in countries who provide adequate data protection regulations under European law, or have given us adequate assurances as to their data protection practices (for example, through a Data Protection Agreement that outlines a third-party service provider’s practices and commitments to protecting the Personal Data we transfer to or through them).

Currently, these services include:

We are, however, ultimately not responsible for the privacy or other practices of any third parties, including those you access through links on our Website through which you may leave our Website and access those of third parties (such as Facebook and LinkedIn).

(3)          For legal reasons.

We will share personal information with companies, organizations, or individuals outside of Seavee if we have a good-faith belief that access, use, preservation, or disclosure of the information is reasonably necessary to:

·      meet any applicable law, regulation, legal process, or enforceable governmental request;

·      enforce applicable Terms of Service, including investigation of potential violations; or

·      detect, prevent, or otherwise address fraud, security, or technical issues, protect against harm to the rights, property, or safety of Seavee, our users or the public as required or permitted by law.

We may share non-personally identifiable information publicly and with our partners—such as publishers, advertisers, or connected sites. For example, we may share information publicly to show trends about the general use of our services.

If Seavee is involved in a merger, acquisition, or asset sale, we will continue to ensure the confidentiality of any personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.

Information security.

We work hard to protect Seavee and our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold. For example, we utilize secure third-party servers to store your information as well as a number of security and authorization protocols to keep it secure.

This Privacy Policy applies to Seavee’s Mobile Services. Our Privacy Policy does not apply to services offered by other companies or individuals, including products or sites that may be displayed to you in Seavee, sites that may include Seavee services, or other sites linked from our services. Our Privacy Policy does not cover the information practices of other companies and organizations who advertise our services, and who may use cookies, pixel tags, and other technologies to serve and offer relevant ads.

Compliance and cooperation with regulatory authorities.

We regularly review our compliance with our Privacy Policy. When transferring data from the European Union, the European Economic Area, and Switzerland, Seavee relies upon a variety of legal mechanisms, including contracts with our users and third parties we use to help process information and provide our Mobile Services.

In order to ensure that your data remains private when shared and processed in other countries, we use Google Cloud servers given their commitment to both International and EU privacy standards. When we receive formal written complaints, we will contact the person who made the complaint to follow up. We will work with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that we cannot resolve with our users directly.

Changes.

Our Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent. We will post any Privacy Policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including email notification of Privacy Policy changes). We will also keep prior versions of this Privacy Policy in an archive for your review.

Visitors from the EU and greater European Economic Area.
